Dieser Brief beschreibt die Formalitäten, Vorschriften und Gebühren für das Einklarieren und den Aufenthalt ausländischer Boote und Jachten in Kroatien.

Dear Sirs,

Thank you for your inquiry. Herewith we are giving you a review of fees being obliged for boater in the part of Adriatic see of Croatia and description of procedure for entering in of boaters.

Pursuant to regulations in force in the Republic of Croatia it has to be paid:

Compensation amounting to 140,00 kn (for boats with length to 3 meters and engine output higher than 4 kW) to 1.750,00 kn (for yacht with length over 30 meters) according to Decree on Compensation Height for Navigation Safety that have to pay the foreign yachts and boats for pleasure and sport (Official Gazette No. 21/98, 29/99); at the repeated entering in for the second year in a raw the compensation will be reduced for 10 % , in the third year 20 % and for 30% at entering in for the fourth year in a raw. (Please find enclosed the photocopies of this regulation.) The Harbour Authority is competent for the implementation.

Compensation for establishing the navigation capability just for those foreign yachts, sailing boats and sport boats that have no adequate ship's documents issued by the country under which flag they are sailing amounting to 55,00 to 250,00 kn depending on length and output of propelling gear (engine) and according to the Decree on Amount for Establishing the Navigation Capability of foreign yachts, sailing boats and sport boats (Official Gazette No. 45/97). Please find enclosed the photocopies of this regulation. The Harbour Authority is competent for the implementation.

By Insurance Act (Official Gazette No. 46/97) and Decision on Amount Fixing for Indemnification of Damage based on third-party damage liability insurance of the owner, i.e. motorboat's user (Official Gazette No. 20/98) there are covered only consequential damages to the amount to 1.400.000 kn and the insurance premium will be paid depending on engine output:

to 15 kW - 0,00 kn

from 15 kW to 30 kW - 180,00 kn

from 31 kW to 50 kW - 270,00 kn

over 51 kW - 360,00 kn

Local tax amounting from 2,00 to 7,00 kn daily for person depending on period of the year (season, pre-season, out-season) and class (A to D) of the tourist place, according to the Local Tax Act (Official Gazette No. 39/95, 42/95, 52/95) and Decree on Fixing the Local Tax Amount for the 2000 (Official Gazette No. 59/99);

But, the users of permanent berth in the nautical tourism port do not pay daily local tax during their stay on the boat at this permanent berth. They will be charged with yearly lump tax amounting to 200,00 kn in accordance with the Decree on Fixing the Yearly Local Tax Lump Amount for user of permanent berth in the port for nautical tourism for the 1999 and the 2000 (Official Gazette No. 59/99).

The yachts on own anchor outside the port for nautical tourism are subject to obligations stated under item 1 to the item 4.

The annual berth rent as well as for transit berth at marinas are to be paid according to the valid marina's price list and they are different depending on price list and business policy of each marina. Please find enclosed the list of Association members, phone, fax numbers and addresses.

With the best will in the world I could not get the list fax numbers of Communes and Towns therefore I ask you kindly to contact the following Counties and to ask for list and fax numbers of Communes and Towns being in their competence:

Referring the ports open for public traffic the berth fee has been fixed by decision of Port authorities' administrative board and not by Criteria for Harbour Duties Fixing By-law. The information about phone and fax number of administrative boards you can get from Ministry of Maritime Affairs, Transport and Communication, Maritime Affairs Office, fax No. ++385/1/389-3986.

The owner, i.e. skipper of foreign vessel intending to sail and stay in inland seawaters of the Republic of Croatia is obliged to call the port for international traffic in inland seawaters by the shortest way and to notify the entering to the competent harbour authority or its branch office.

The skipper will ask for inland seawaters and territorial sea of the Republic of Croatia navigation permit proving his qualification by passed examination for conducting the boat or qualification certificate of the state to which he belongs.

The skipper will present the documents being valid and issued by competent authority of the country under which flag the boat is sailing. In case the skipper does not possess the correspondent documents of the country under which flag the boat is sailing, the harbour authority, i.e. harbour branch office will inspect the boat in accordance with the Decree on Amount for Establishing the Navigation Capability of Foreign Yachts, Sailing Boats and Sport Boats (Official Gazette No. 45/97) due to issue the permit for territorial sea and inland seawaters navigation. The compensation for the above said inspection depends on propelling gear and vessel length and amounts to from 55,00 to 250,00 kn.

The vessel with driving engine higher than 15 kW must be third-party damage liability in the marine traffic and natural persons insured with a insurance company abroad or in the Republic of Croatia. According to the Insurance Act (Official Gazette No. 46/97) and Decision on Damage Indemnity Fixing based on owner's insurance, i.e. motorboat's user for third-party damage liability (Official Gazette No. 20/98), the insured sum for the single insured case amounts to 1.400.000 kn.

At issuing the first entering in and stay in the territorial sea and inland seawaters the skipper of the foreign vessel will pay the compensation for navigation safety amounting to 140,00 to 1.750,00 kn depending on vessel length.

The owner, i.e. skipper of vessel will specified the data about passengers - crew members and this list has to be certified by the harbour authority, i.e. harbour branch office. The skipper is obliged to register any change referring to crew members and to verify it at the competent branch office or harbour authority.

Within 24 hours after calling the port the skipper will notified the check-in to the competent police station. Marina or the agency can do the said notification instead the skipper. At the port leaving the skipper, marina or the agency will do the check-out at the police station.

The skipper is also obliged to notify the vessel's stay at the port or natural bay/mooring place to the competent tourist community office and such stay check out before leaving the port. There has been working on computer system that will essential simplify the check-in and check-out procedure for yachts and vessels.

The owner or skipper of transit vessel will pay the local tax for his self and crew members at checking out amounting to 2,00 to 7,00 kn depending on period (season, pre-season, after-season, out of season) and class (A to D) of the tourist place. For the vessel on stationary berth will be paid the lump amount to 200,00 kn yearly.
